The independence and impartiality of Supreme Court and Constitutional Court justice is one of the important issues in the concept of a democratic state based on the principles of constitutionalism, including in Indonesia. The involvement of Supreme Court and Constitutional Court justice in bribery cases and various violations of the code of ethics has made researchers continue to study the factors causing Supreme Court and Constitutional Court justice to still fall into bribery cases and violations of the code of ethics. This research focuses more on one aspect that is a contributing factor, namely weaknesses in the appointment of Supreme Court and Constitutional Court justice. The author conducted in-depth research for two years by evaluating the weaknesses and advantages of the selection system for Supreme Court and Constitutional Court justice in Indonesia. In addition, the author also conducted a comparative study on the selection model of Supreme Court Justices in Malaysia and India and the Constitutional Court justices selection system in Germany.
This book comprehensively describes the advantages and disadvantages of each system of appointment of Supreme Court and Constitutional Court justice in related countries. This book also formulates an alternative model of appointing Supreme Court and Constitutional Court justice, which is expected to overcome the weaknesses of the current model of appointing Supreme Court and Constitutional Court justice.
